Our services are intended for use by individuals who are 18 years of age or older. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements. If you are using our services on behalf of a business entity, you represent that you have the authority to bind that entity to these terms.
While we serve clinics and healthcare-adjacent businesses, Visibility Protocol does not provide medical advice, diagnosis, or treatment recommendations. Our marketing, content, and AI services are strictly business and promotional in nature. Any content we create for healthcare clients must be reviewed by appropriately licensed professionals before publication, and clients are solely responsible for ensuring their marketing materials comply with applicable healthcare regulations.
By providing your contact information and engaging with our services, you consent to receive communications from Visibility Protocol via email, phone, and SMS. These communications may include service updates, project status information, marketing materials, and business-related messages. You may opt out of marketing communications at any time by contacting us directly or following the unsubscribe instructions in any communication. Opting out of marketing communications will not affect transactional or service-related messages.

All content, materials, and deliverables created by Visibility Protocol remain our intellectual property until full payment is received, at which point ownership transfers to the client as specified in the service agreement. Our proprietary methodologies, processes, and systems remain the exclusive property of Visibility Protocol at all times. You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.
Visibility Protocol shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim related to our services shall not exceed the amount paid for the specific service giving rise to the claim in the three months preceding the claim. We do not guarantee specific results from our marketing or SEO services, as outcomes depend on many factors outside our control.
Our services may involve work on or integration with third-party platforms such as Google, Meta, social media networks, or other digital tools. We are not responsible for changes to these platforms' policies, algorithms, or terms that may affect the performance of our services. Clients are responsible for maintaining their own accounts and credentials on third-party platforms.
Either party may terminate a service agreement with written notice as specified in the individual service agreement. Upon termination, you remain responsible for any fees incurred up to the termination date. We reserve the right to immediately terminate services if you violate these Terms of Service or engage in conduct that we reasonably determine to be harmful to our business or other clients.
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website with a new effective date. Your continued use of our services after any changes constitutes acceptance of the updated terms. We encourage you to review these terms periodically.
These Terms of Service shall be governed by and construed in accordance with applicable federal law and the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be subject to binding arbitration or resolved in a court of competent jurisdiction.
